I only had 5
volt AVRs handy, if I had had a 3V version I would have added a 3V
regulator and used it.
R3 and R4 are shorted out after the circuit
has been tested. They just provide a little protection while the
connections are tested. With the resistors in circuit the AVR still
goes through the motions but can't jam the data lines.
